iRunshop operates an online platform allowing users to create and market their personal clothing and various merchandise. We legally forbid our users to design or sell items that violate the intellectual property rights of others, such as copyrights, trademarks, and connected rights. Should you suspect a user on iRunshop's platform has violated your intellectual property rights, please follow the process detailed below to report it.

A. How to Report Intellectual Property Infringement:

iRunshop's strategy is twofold: (1) block or remove content (like text, images, and photos) believed in good faith to breach third-party intellectual property rights upon receiving a proper notice, and (2) halt service to repeat offenders.

If you think content on the iRunshop platform infringes your copyrights or other intellectual property rights, send a notice with the following details to the Designated Agent provided at the end:

  1. Information about the infringed intellectual property, including registration numbers if available;
  2. Description of the allegedly infringing content, detailing how and where it is found on iRunshop;
  3. Your contact details including name, address, phone number, and email;
  4. A declaration stating your belief that the use of the intellectual property is unauthorized;
  5. A sworn statement verifying the notice's accuracy and your authority to act for the rights holder;
  6. Your electronic or physical signature.

B. Actions Taken Upon Receipt of Valid Infringement Notice:

iRunshop's policy is:

  1. To remove or restrict access to the offending content;
  2. To inform the member involved;
  3. To remove repeat offenders from the service, terminating their access.

C. Counter-Notice Procedure:

If a member disputes the removal or restriction, believing it to be incorrect, or that they have the right to use the content, they must send a counter-notice with:

  1. Details of the removed or restricted content;
  2. A sworn statement that the content was mistakenly identified;
  3. Contact information;
  4. Agreement to the applicable legal jurisdiction and willingness to accept legal process;
  5. An electronic or physical signature.

Should iRunshop receive a counter-notice, it may inform the original complainant that the content may be reinstated or access restored within 10 to 14 business days, at iRunshop's discretion, unless legal action is initiated.

Please be aware that knowingly providing false infringement claims under Section 512(f) of the DMCA may result in liability for damages, including legal fees.
